1. Acceptance of Terms

By accessing or using InstaSet ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

InstaSet is an AI-powered Instagram direct message automation platform that helps businesses qualify leads, respond to inquiries, and book appointments automatically. The Service integrates with Instagram via the Meta API to send and receive messages on your behalf.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Have authorization to connect the Instagram accounts you integrate
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

4. Instagram Integration

By connecting your Instagram account to InstaSet, you:

  • Authorize us to access, read, and send messages on your behalf
  • Confirm you have authority to grant this access
  • Agree to comply with Instagram's Terms of Use and Platform Policy
  • Understand that violations may result in Instagram revoking access

We are not responsible for any actions taken by Instagram/Meta regarding your account, including suspension or termination of API access.

5. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, unsolicited messages, or bulk automated messages
  • Harass, abuse, or harm other users
  • Violate any applicable laws or regulations
  • Impersonate others or misrepresent your identity
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Scrape or collect data for unauthorized purposes
  • Use the Service for any illegal or fraudulent activity
  • Violate Instagram's Terms of Use or Community Guidelines

6. AI-Generated Content

Our Service uses artificial intelligence to generate message responses. You acknowledge that:

  • AI responses are generated based on your configuration and training data
  • AI may occasionally produce unexpected or inaccurate responses
  • You are responsible for reviewing and configuring AI behavior
  • You should regularly monitor conversations for quality
  • We are not liable for any damages caused by AI-generated content

7. Subscription and Payments

7.1 Billing: Subscriptions are billed in advance on a monthly basis. You authorize us to charge your payment method for recurring fees.

7.2 Free Trial: Free trial periods are limited to 7 days and 100 AI credits. After the trial, you must subscribe to continue using the Service.

7.3 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

7.4 Refunds: Refunds are provided at our discretion. Generally, we do not provide refunds for partial months or unused credits.

7.5 Price Changes: We reserve the right to modify pricing with 30 days notice. Continued use after price changes constitutes acceptance.

8. Credits and Usage Limits

AI responses consume credits based on your subscription plan. Unused credits do not roll over to the next billing period. Exceeding your credit limit will pause AI responses until your next billing cycle or until you upgrade your plan.

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by InstaSet and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you provide (training data, conversation examples, etc.). By providing content, you grant us a license to use it to provide and improve the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTASET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless InstaSet, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will cease immediately
  • We may delete your account and data
  • You remain liable for any fees incurred before termination

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in the United States.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
